TERMS OF USE AND END USER LICENSE AGREEMENT

GENERAL INFO

This document includes the Terms of Use and End User License Agreement (collectively referred to as the "ToU"), together with all related documents, forms a legally binding contract between you, the individual user ("you", "your", or "user"), and - Funny Games and Apps Studio ("we", "us", or "our"). This ToU is about your access and use of one or more of our Mobile Games ("the Game(s)").

All the documents related to the Game(s) are incorporated by reference into this ToU.

Please read this ToU carefully before downloading, installing, or using the Game(s).

Our Privacy Policy provides information on how we collect and use personal data.

By downloading, installing, or using the Game(s), you signify that you have read, understood, agreed to, and accepted this ToU, which becomes effective on your download, installation, or use date. By using the Game(s), you consent to comply with this ToU.

We are authorized to alter or end this ToU at any time solely at its discretion and for any reason. Upon termination, the rights and licenses provided to you in this ToU will no longer be valid. Consequently, you must cease all usage of the Game(s).

You must be at least thirteen (13) years old to download, install, access, or utilize the Game(s).

Individuals under the age of thirteen (13) years old are not allowed to download, install, access, or utilize the Game(s).

If you are between thirteen (13) and seventeen (17) years old and want to use (download, install, access, etc.) the Game(s), make sure your parent or legal guardian has read and agreed (and given their consent) to this ToU before you start downloading, installing, accessing, or utilizing the Game(s).

By downloading, installing, accessing, or utilizing the Game(s), you're saying that:

you're either above eighteen (18), legally recognized as independent as a minor, or have the required consent from your parent or legal guardian, and
you're also affirming that you have the complete ability and capability to agree to the terms, conditions, responsibilities, statements, representations, and warranties specified in this ToU. Furthermore, you are dedicated to abiding by and adhering to these ToU.

Parents and guardians are responsible for preventing any unauthorized, irrelevant, indecent, and/or immoral use of the Game(s) by their minors who have not reached the age of majority or legal age in the applicable jurisdiction.

LICENSE

You're entitled to access and use the Game(s) in accordance with these ToU, and we grant you a non-exclusive, non-transferable, non-sublicensable, non-assignable, and revocable permission to do so. It's mandatory for you to follow these ToU and comply with all applicable laws when using the Game(s).

The Games are exclusively designed for entertainment purposes. You are authorized to access and use the Game(s) exclusively for your personal and non-commercial intentions.

It is essential that you uphold the rights of the copyrighted material (source code, design, content, such as information, photographs, illustrations, artwork, graphic materials, sounds, music, or video, etc.; this also includes names, logos, and trademarks) found within the Game(s).

We and/or our partners and/or contracted third parties hold all exclusive rights, titles, and interests to the Game(s), its content, works, means of individualization, and functionalities. These are protected by relevant international and national laws and are not, under any circumstances, transferred or assigned to you, either in full or in part.

You agree to use the Game(s) only in lawful and authorized ways, ensuring no infringement upon the copyrights, database rights, or trademarks of others.

It's important to note that we reserve the right to take any legal action available to us under applicable laws against a user who violates this ToU.

All disputes arising from the use of the Game(s) will be governed by and construed in accordance with the laws of the United States of America. Such disputes will be exclusively subject to the jurisdiction of the competent courts in New York and the United States of America.

TECHNICAL REQUIREMENTS

The Games are compatible for download and installation on handheld mobile devices running Android Operating System 6.0 or later.

CHARGES

The Games are available for free, and upon download, you'll have access to its basic features.

Some services or additional Game(s) features may be accessible through In-App Purchases.

WARRANTY DISCLAIMER, LIABILITY & DAMAGES

The services and all materials, information, software, and integrated content within the Game(s) are provided in their current state and availability “as is”, without any warranties or guarantees.

We shall not be held liable for any form of damages, be they direct or indirect, arising from or in connection with the Game(s) and its services under any circumstances. Our responsibility does not extend to special, consequential, incidental, exemplary, or punitive damages, nor does it cover any loss of profits or revenues, even if we have been explicitly advised of the potential for such damages. Moreover, we disclaim liability for damages associated with products, services, and/or information offered or provided by third parties accessed through the Game(s) or any other means. It's important to underscore that we are not accountable for costs or damages resulting from legal actions, whether initiated by private entities or governmental authorities, related to your use of the Game(s) and its services in any country.
